Digital Product - Terms and Conditions

Terms and Conditions for Digital Health Product:

  1. Practitioner Consult Requirement: The use of our digital health product requires a mandatory consultation with a licensed medical practitioner. No results, analysis, or reports will be provided unless the consultation has been completed.

  2. Refunds Policy: As this is a digital health product, no refunds will be provided once the pathology test has been performed. If a cancellation request is submitted before the pathology test, a 50% refund will be provided due to the digital generation of the referral, which is an immediate digital product delivered post payment.

  3. Limitation of Liability: Our company's liability is limited to the extent permitted by law. We are not responsible for any damages, including, but not limited to, indirect, incidental, or consequential damages, loss of profits, or any other losses resulting from the use of our digital health product.

  4. No Guarantee of Service Delivery Time: As there is a dependency on the client attending a pathology laboratory, no guarantee can be given of service delivery time. Therefore, a product will not be cancelled or refunded due to non-attendance by the client or due to excessively long processing times by any of our underlying partners.

  5. Intellectual Property: The client agrees not to copy, reproduce, or distribute any part of our platform or products, including any proprietary information, trademarks, or other intellectual property, without our express written permission.

  6. Privacy Policy: We are committed to maintaining your trust and confidence by ensuring the privacy and security of your personal information. When agreeing to our terms and conditions, you are also agreeing to our Privacy Policy, which can be found here.

  7. Right to Charge Additional Fees: We reserve the right to charge additional fees in the following circumstances: a. The client presents their referral multiple times to a pathology center. b. The client does not present to our partner pathology laboratory that is clearly named in the documentation sent to them. c. The client has been delivered a referal, then has requested and is provided a refund. The client then attends our partner pathology laboratory to have a pathology test. In this case, the full charge for the EPP will be automatically deducted from the clients payment provider, d. Additional financial fees incurred from other financial parties such as Credit Card, Paypal, or Stripe.

  8. Refunds and Payments: If we owe you money, we will process those funds within 30 days of agreeing to transfer the funds. Any additional time delays due to financial institutions are outside of the 30-day period.

  9. Your Account with Us: a. The client is required to provide accurate and complete information when creating an account to ensure the best possible medical diagnosis. b. Our services are intended for use by users located in Australia. c. We reserve the right to not process and/or terminate accounts without cause, at our sole discretion.

By using our digital health product, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, you must not use our digital health product.
